The Affordable Access to Prescription Medications Act of 2009 was introduced in the Senate on August 6 by Senator John D. (Jay) Rockefeller IV. The legislation is aimed at protecting all Americans from high out-of-pocket spending on prescription drugs. Arthritis patients who take several medications -- some of which are expensive biologics -- could be helped significantly.
The proposed legislation would cap prescription drug costs -- a $200 cap on any one prescription and a $500 cap on the total out-of-pocket cost for all prescriptions purchased in any given month. The caps would apply to all public and private insurance plans, including Medicare Part D prescription drug plans. The bill also would provide easier access to biologic drugs, which are on specialty tiers, by allowing any beneficiary to request any necessary prescription drug through the exceptions process.
The Arthritis Foundation is encouraging arthritis patients to take action and let their senators know if they would benefit from the legislation.
