Jury Finds Merck Not Liable in Second Vioxx Case
Thursday November 3, 2005
Merck, the maker of Vioxx, was found to be not liable by a New Jersey state jury for the 2001 heart attack of a man who had been taking Vioxx for two months prior to suffering the attack. The jury deliberated less than eight hours over three days in the second Vioxx lawsuit. The jury decided that Merck did not fail to warn consumers about the risks associated with taking Vioxx and did not engage in "unconscionable commercial practices" when marketing the drug.
