Vioxx Lawsuit: Jury Holds Merck Liable In Wrongful Death Case

A jury has decided the first Vioxx lawsuit, a wrongful death case heard in a Texas courtroom. By a 10-2 vote on August 19, 2005, the jury held Merck (the maker of Vioxx) liable for the death of Robert Ernst in 2001 and awarded $253.4 to the widow. Merck is expected to appeal, and the award is expected to be reduced according to Texas state law.
